Alternative Dispute Resolution

Anania Bandklayder Blackwell Baumgarten Torricella & Stein actively participates in the resolution of disputes by means other than trial before the state and federal courts of Florida. While the trial of certain actions may be desirable, necessary, or unavoidable, many other matters are appropriate for resolution by alternative means, such as private negotiation, early evaluation, mediation, arbitration, or mini-trial. To compliment those procedures, the firm also conducts focus groups, mock trials, and other such activities in order give its clients additional bases upon which to evaluate their prospects or risks and to provide insight into the jury appeal of particular arguments, positions, or evidentiary emphases.

The lawyers at the firm work with the firm’s clients to identify those cases that can benefit from early efforts at dispute resolution and to tailor an approach to maximize the chances of achieving a successful resolution of the dispute. The firm recognizes that, ultimately, a negotiated resolution to a conflict can offer its clients the best chance to maximize their recovery or minimize their exposure, promptly move past the distractions that litigation can foist upon a business and, perhaps, forge a new and mutually advantageous business relationship from an affiliation fractured by a past business disagreement.
