INSURANCE LITIGATION
An airline ramp agent working at Miami International Airport claimed that he suffered considerable neck, shoulder, back, arm and hand injuries after a water truck operated by an employee of a ground service provider allegedly struck a baggage tug that the airline ramp agent was operating. Anania Bandklayder Blackwell Baumgarten Torricella & Stein suspected that the ramp agent manufactured the claim and resulting injuries. Through aggressive discovery, the firm uncovered a series of misrepresentations, omissions, and other evidence that firmly established that the alleged incident never occurred and that the ramp agent's claims were fabricated. After presenting that evidence to the Court, the firm succeeded in securing the dismissal of the ramp agent's claims on the grounds of fraud on the Court.

The cargo airline retained Anania Bandklayder Blackwell Baumgarten Torricella & Stein. After suffering the entry of an adverse jury verdict totaling almost one million dollars in an employment discrimination lawsuit, an employer retained Anania Bandklayder Blackwell Baumgarten Torricella & Stein to represent its interests. Based upon its diligent pursuit of post-trial discovery, the firm secured an order setting aside the verdict and dismissing the claim, and awarding attorney's fees to the employer, based upon the trial court's finding that the employee had "misled and deceived" the employer, the jury, and the court "about matters which strike at the heart of" the employee's claims. The employee appealed the trial court's order and the appellate court unanimously affirmed the trial court's ruling.
